Digital Entry Terms of Use

1. Upon receiving a digital key, the first night's charges will be applied to your credit card on file.
2. Credit and Debit Card Processing
a. Upon check-in, your card issuing bank will place a hold on your debit or credit card for room & tax charges, any applicable resort fees, plus an amount for incidentals per day for the entire stay.
b. This hold will not be released by the issuing bank for up to five (5) business days after your departure.
c. You authorize the motel to place this hold against your credit or debit card to guarantee any and all charges and, in the event that you do not settle your account subsequent to your departure, you hereby authorize the motel to charge your credit or debit card or apply funds you have on deposit with the motel against what you owe.
3. Every effort will be made to accommodate your requests for specific room type and location, however, the motel is unable to guarantee any requests as rooms are not assigned until check in. Additional fees may apply depending on the specific requests.
4. Nightly Resort Fees may apply.
5. Additional charges per occupant, per night, above 2 occupants per room may apply.
6. Regardless of billing or master account arrangements, you are liable for any and all charges posted to your room(s). You are further liable for all damages to the room(s) caused by you or your guests/invitees during your stay.
7. If there is evidence of smoking in your room you will incur a deep cleaning fee charged to your account.
8. Should your plans require you to adjust your departure date, please check with the Front Desk on room availability, but note that your rate is subject to change. Please notify the Front Desk immediately if there are any errors to name, rate or length of stay.
9. You agree that any guests in your room are authorized by you to charge to the room from anywhere in the Motel or on motel premises, unless you advise the Front Desk otherwise.
10. By providing your e-mail address, you consent to receiving promotional e-mails from The Vaquero Motel and its related and/or affiliated properties.
11. To the maximum extent permitted by law, we, other members of our group of companies and third parties connected to us hereby expressly exclude any liability for any direct, indirect or consequential loss or damage incurred by any user in connection with his/her use, or inability to use, a digital key, including, without limitation any liability for loss of income or revenue; loss of business; loss of profits or contracts; loss of anticipated savings; loss of data; loss of goodwill; and for any other loss or damage of any kind, however arising and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable.
12. In the event required by local law, we may ask you to manually sign a guest registration card, provide identification and/or provide information on any vehicles you may have on the motel premises.
13. For your Security
a. Use Safety Deposit Box for valuables if available.
b. Secure deadbolt and doorguard.
c. Use viewport to ID all visitors.
d. Safeguard and keep your keycard and personal electronic device containing your digital guestroom key with you at all times.
e. Ensure that all windows and doors are lock

To ensure that The Vaquero Motel provides a safe and comfortable stay to guests, the following rules need to be followed. Not abiding by these rules may lead to cancellation of stay and/or refusal to use the motel facilities.
Further, if you damage any equipment or fixtures on the motel premises, The Vaquero Motel reserves a right to charge you the full cost of the damages.

Rules including and/or not limited to:

1. Do not use the guest rooms for purposes other than intended without authorization.
2. Do not light a fire in the cabins for heating or cooking. Use of fire pits or grills not provided by The Vaquero Motel are strictly prohibited. 
3. All cabins are non-smoking. Smoking is allowed in designated areas. Failure to comply with policy will result in a $250 smoking-fee.
4. The equipment and decorations in guest rooms are strictly meant for the guests staying in the Motel.
5. Be careful not to move the articles in the Motel or cabins from their fixed places without permission.
6. Exotic animals or dogs that weigh over 50lbs are not allowed. A non-refundable deposit of $75 will be applied for pets per cabin. Service dogs that qualify under the ADA are permissible and will not be charged a fee.
   
7. Do not distribute advertisement goods or sell articles to the other guests or collect donation or signatures from them on the Motel premises, without proper permission.
8. Any acts of photography that may disturb the other guests of the Motel are strictly prohibited on the premises.
9. If bringing a firearm onto the property, we ask that you secure it in a locked, hard-sided container and safeguard it in your cabin or personal vehicle. Explosives, or articles containing volatile oils that may ignite or catch fire are strictly prohibited.
   

We reserve the right to cancel or modify reservations where it appears that a customer has engaged in fraudulent or inappropriate activity or under other circumstances where it appears that the reservations contain or resulted from a mistake or error, or from an attempt to circumvent The Vaquero Motel or motel policies, terms or conditions. You understand that overuse or abuse of the reservation facilities of this site may result in your being denied access to such facilities. Reservations made by one or more individuals or by an agency on the site, on behalf of one or more proposed guests, and involving more than five (5) rooms at the same motel for the same period of stay, must be made directly through the motel. If more than five (5) rooms at the same motel for the same period of stay are booked through any other method, we reserve the right to cancel or impose additional requirements on such reservations. Some rates have special eligibility requirements such as Government Rates, AAA or AARP membership. It is your responsibility to verify that you qualify for the rate that you have booked. The Vaquero Motel is not obligated to honor rates if you do not qualify.

By using the website and booking a reservation, you agree to the terms as well as the following text messaging terms, and agree to receive text messages with updates and information about your reservations, communication with the motel team, as well as texts with offers and promotions, from and on behalf of The Vaquero Motel, including text messages sent using an autodialer, at the telephone number(s) you provided. Consent to receive text messages is not a requirement or a condition of any purchase. You understand and agree that by checking the box to sign up to receive text messages, you are providing your digital signature. By opting in to receive text messages, you represent that you are 18 years of age or older. The Vaquero Motel reserves the right to change, update, or correct any of the Text Terms at any time by posting amended terms to this website. Your continued consent to receive messages will indicate your acceptance of such changes. Message and data rates may apply to each text message sent or received in connection with text messages, in addition to any applicable roaming charges. Not all carriers covered and supported carriers may change from time to time. The Vaquero Motel does not guarantee availability or performance of the text message service and you understand that transmission delays and message failures may occur. You represent that you are the account holder for the telephone number(s) that you provide. You are responsible for notifying The Vaquero Motel immediately if you change your mobile telephone number. You agree to indemnify The Vaquero Motel for any claims, expenses, and/or damages related to or caused in whole or in part by your failure to notify the motel if you change your telephone number, including, but not limited to, all claims, expenses, and damages related to or arising under the Telephone Consumer Protection Act. The Vaquero Motel may suspend or terminate your receipt of The Vaquero Motel text messages at any time. The Vaquero Motel reserves the right to modify or discontinue, temporarily or permanently, all or any part of the motels text message services, with or without notice.

The Vaquero Motel is not responsible or liable to you, or any person claiming through you, for failure to supply or fulfill a reservation in the event the Motel or its operations are affected by any acts of god, any action, regulation, order or request by any governmental or quasi-governmental entity, equipment failure, actual or threatened terrorist acts, weather, natural phenomenon, war (declared or undeclared), fire, embargo, labor dispute or strike, labor or material shortage, transportation interruption of any kind, civil disturbance, insurrection, riot, pandemic/epidemic (or similar public-health threat or emergency), or any laws, rules, regulations or orders or other action adopted or taken by any national, federal, state, provincial, or local government authority, or any other cause, whether or not specifically mentioned above.

You agree that nothing contained in these Terms is in derogation of The Vaquero Motel's right to comply with law enforcement or governmental requests or requirements relating to your stay or information provided to or gathered by The Vaquero Motel with respect to such participation.
